Thanks for your interest in submitting an access request proposal to Rogers TV. The information below will give you an idea of what we're looking for, and the terms and conditions associated with program proposals, event coverage or appearances on existing Rogers TV shows.

Our Mandate

Rogers TV's mandate is to be very local, so we're most interested in ideas that directly relate to the people who live in Brampton. Be sure to explain the specific local angle or local niche your show, event or appearance captures, and how it’s relevant to this area.

Sponsorship

If you would like Rogers TV to cover your event, there is no charge to you or your group to record and broadcast your event. Rogers TV, however, may solicit sponsors to offset the cost of producing the program. Sponsorship funds are used to help initiate or improve Rogers TV programs. Sponsorship acknowledgements may appear during the course of the coverage of your event. No sponsorship agreements for any Rogers TV program may exist without Rogers TV’s agreement.

Event Coverage

When requesting event coverage, provide as much advance notice as possible. A minimum of 3 to 4 weeks of lead time is best.

Furthermore, legal problems may arise if any part of your event is protected by copyright. Any song, music, play or work created by an author who is alive or has not been dead for more than 50 years may be copyright protected in Canada. Any person performing or recording such a work must obtain permission from the owner of the copyright before the work is performed or recorded. It is your obligation or your organization’s to ensure that all copyright and usage permissions are secured prior to recording and production by Rogers TV.

Please read all of the following information completely and carefully.

In order to submit your proposal, you must also read and agree to the Program Proposal Agreement and Release. A summary of the important issues, are below. The complete Program Proposal Agreement and Release follows this summary.

• Rogers TV is not obligated to use or publish the proposal in any manner.
• You acknowledge that Rogers TV receives numerous program, event, appearance proposals and other material from other sources, and Rogers TV also creates such ideas and materials. These ideas may be similar to those in the proposal you are submitting, but you are submitting the proposal at your own discretion, on this understanding.
• You acknowledge that no relationship or partnership is created between you and Rogers TV when you submit the proposal.
• You acknowledge your involvement in the development of a Rogers TV program or an appearance on an existing Rogers TV show is on a volunteer basis.
• You expressly and irrevocably release and forever discharge Rogers TV and its affiliated and associated companies from any and all actions and liabilities whatsoever, arising directly or indirectly out of Rogers TV’s use of the proposal.
• You represent and warrant that no component of the proposal you submit is copied from any other work.
• You represent and warrant that you have the full right to grant the permissions required to Rogers TV, and that no further permissions from or payments to any third party are required in connection with the proposal.
• You represent and warrant that the proposal does not defame any person or infringe on any copyright or any other rights of any person or company, or violate any law or order.
• You agree to indemnify Rogers TV and its affiliated companies from and against any claims, losses and expenses due to your breach of this agreement.
• Once you submit the proposal, you do not have any right to terminate the permissions granted.

Program Proposal Agreement and Release

1. Nothing herein shall obligate Rogers TV to use or publish your submission regarding a proposed program or series on Rogers TV (the “ Proposal”) in any manner, nor does Rogers TV have an obligation to contact you with regards to the Proposal.
2. You acknowledge that Rogers TV receives numerous submissions of ideas, stories and other materials from other sources and, in addition, Rogers TV creates, and/or commissions others to create such materials on Rogers TV’s behalf, (collectively the " Rogers TV Materials"). The subject matter and substance and/or other elements contained in the Rogers TV Materials may be similar to those contained in the Proposal. You expressly and irrevocably understand, acknowledge and agree that Rogers TV is accepting the Proposal at your request, which request was and is deemed to have been made by you knowing that there are or may be pre-existing Rogers TV Materials which may be similar in subject matter, substance and/or other elements, to those found in the Proposal. You also expressly and irrevocably understand, acknowledge and agree that Rogers TV may also in the future develop Rogers TV Materials which may be similar in subject matter, substance and/or other elements, to those found in the Proposal. As such, you have no claims or rights, including any moral rights, to any Rogers TV Materials.
3. You acknowledge that there is no relationship of any type created, including without limitation any agency, or fiduciary relationship, as between you and Rogers TV, by virtue of the submission by you of the Proposal to Rogers TV hereunder.
4. You hereby expressly and irrevocably release and forever discharge Rogers TV, its parent, subsidiary, affiliated and associated companies, and their directors, officers, employees, agents, representatives, independent and dependent contractors, licensees, successors and assigns of and from any and all actions, causes of action, suits, proceedings, liability, debts, judgments, claims and demands whatsoever in law or equity which you ever had, now have, or hereafter can, shall or may have, for or by reason of, or arising directly or indirectly out of, Rogers TV’s use of the Proposal.
5. You represent and warrant that:
   1. the Proposal you submit, and each and every of its component elements, are wholly original with you and not copied in whole or part from any other work;
   2. you have the full and complete right to grant the permissions given hereunder to Rogers TV, and that no further permissions are required from, nor payments required to be made to any third party in connection with the use by Rogers TV of the Proposal as contemplated herein; and
   3. the Proposal does not defame any person and does not infringe upon the copyright, moral rights, publicity rights, privacy rights or any other right of any person, or company, or violate any law or judicial or governmental order.
6. You hereby agree to indemnify and hold harmless Rogers TV, its partners, co-producers, financiers and distributors, their parent, affiliated and related companies, and all of their respective individual shareholders, directors, officers, employees, licensees and assigns from and against any claims, actions, losses and expenses (including legal expenses) occasioned by any breach of your representations and warranties or any other provision of this license, release and waiver.
7. You shall not have any right to terminate the permissions granted herein, nor to seek, obtain, or enforce any injunctive or other equitable relief against Rogers TV, all of which such rights are hereby expressly and irrevocably waived by you in favour of Rogers TV.
8. You acknowledge having obtained independent legal advice in connection with this license, release and waiver, failing which, you shall be deemed to have voluntarily waived the right to seek such independent legal advice.
9. Except to the extent that they conflict with the license, release and waiver terms of the upload of the Proposal, the general terms and conditions for use of the Rogers TV Site and other Rogers sites (collectively the “General Terms and Conditions”) are also applicable to your submission of the Proposal and such General Terms and Conditions are incorporated into this release, waiver and license. If those General Terms and Conditions conflict with the terms and conditions of this license, release and waiver, this license, release and waiver will govern.
10. This license, release and waiver shall be governed by the laws of the Province of Ontario and the laws of Canada applicable in such Province.
11. By submitting this form, you signify that you have read and understand the above sections and agree to all the terms and conditions which they outline and release Rogers TV from all liability.
12. This agreement was drawn up in English at the express request of the Parties. / La présente entente a été préparée en anglais à la demande expresse des parties.
